The leader of the Arauco Malleco Cordinator is soliciting the Concepcion Court of Appeals to revoke the decision made by the parole board, which denied his claim last Novemeber.
The claim was made by defense attorney, Omar Castillo, in representation of Hector Llaitul, who is currently serving time for the alleged attack against State Prosecutor, Mario Elgueta, in 2008.
The legal action was taken by the Court of Appeals of Concepcion, which then immediately solicited a report from the Parole board. The solicitation’s 24 hour dealine will then be promptly be followed by a ruling.
The main argument to revoke the current verdict is the fact that the judges were not unanimous in reaching a resolution. It should be noted that Judges Matilde Esquerre and Raul Martines were in favour of granting parole, since they condiered that Llaitul complied with all the requirements necessary for parole.
However, the Majority vote indicated that it was necessary to continue his strict supervision, as carried out through the Gendarmerie, in order to truly asses the good behavior Llaitul would need to regain his freedom.
The CAM leader currently has the benefit of weekend release, while Ramon Llanquileo, whom was also convicted for his alleged participation in the attack against Prosecutor Elgueta, managed to obtain parole this past November.
In the case that the Appeals Court of Concepcion rejects the current claim, the Defense could resort to the Supreme Court for a definitive verdict.
